As part of implementing personal data protection within our organisation, we have decided not to appoint a Data Protection Officer, as this is not mandatory in our circumstances. Depending on the purpose, we may process the following information about you:

In most cases, you provide it to us yourself. This happens when:

  • you register a user account,
  • you place an order,
  • you submit a complaint or withdraw from a contract,
  • you subscribe to the newsletter,
  • you add a comment or review about a product,
  • you contact us.

In addition, some information about you may be automatically collected by the tools we use:

  • the website and newsletter system collect your IP address,
  • the website’s system collects information about the products you have viewed and the details of orders placed, including those that were not completed,
  • the newsletter system collects information about your activity in relation to the content sent to you as part of the newsletter, such as opening messages, clicking on links, etc.,
  • Google Analytics and Facebook Analytics collect a range of information about how you use our website.

We take the security of your personal data seriously. We have analysed the risks associated with each process involving the processing of your data and have subsequently implemented appropriate security and data protection measures. We continuously monitor the condition of our technical infrastructure, train our staff, review our procedures and implement any necessary improvements. There is more than one such purpose. A list of these is provided below, followed by a more detailed explanation. We have also assigned the relevant legal bases for processing to each specific purpose.

  • order processing – Article 6(1)(b) of the GDPR,
  • handling complaints or contract withdrawals – Article 6(1)(f) of the GDPR,
  • sending the newsletter – Article 6(1)(a) of the GDPR,
  • handling comments or product reviews – Article 6(1)(a) of the GDPR,
  • handling correspondence – Article 6(1)(f) of the GDPR,
  • fulfilment of tax and accounting obligations – Article 6(1)(c) of the GDPR,
  • creating an archive for the purposes of any potential defence, establishment or pursuit of claims, as well as for the purpose of identifying returning customers – Article 6(1)(f) of the GDPR,

User account – details

When creating a user account, you must provide the data necessary to set up the account: an email address and a password. Providing this data is voluntary but necessary to create an account.

When editing your account details, you can provide further information, in particular details that may be used when placing orders, such as your full name, home address or business address, tax registration number and telephone number.

If you create an account by linking it to your social media account, we will, on the basis of your prior authorisation, gain access to certain data held within your social media account (full name, email address, profile picture).

We analyse this information about you in order to optimise our websites in terms of user experience, effectiveness and conversion rates, which constitutes our legitimate interest as referred to in Article 6(1)(f) of the GDPR.

You may amend the information about yourself provided to us in connection with your user account registration at any time. However, if you created your account using the social media account integration, the data retrieved from that social media platform can only be amended or deleted via that platform.

The data you have provided in connection with creating your account is processed for the purpose of providing you with an electronic service consisting of enabling you to use your user account. This service is provided on the basis of a contract concluded in accordance with the terms set out in the terms and conditions, which means that, in this respect, the legal basis for the processing of your personal data is Article 6(1)(b) of the GDPR.

The data will be stored for as long as your user account remains active. You may decide to delete your account at any time; however, this will not result in the removal from our database of information regarding orders you have placed using that account. Order data is stored in our archive for the entire duration of the website’s operation in order to ensure that we can identify returning customers, reconstruct their purchase history, track discounts granted, etc., which constitutes our legitimate interest as referred to in Article 6(1)(f) of the GDPR.

Newsletter – details

By subscribing to the newsletter, you provide us with your first name and email address. Providing this information is voluntary but necessary to subscribe to the newsletter.

Furthermore, our newsletter management system records the IP address you used when subscribing to the newsletter, determines your approximate location, identifies the email client you use to manage your email, and tracks your interactions with the messages sent to you. Consequently, we also hold information on which messages you have opened, which links you have clicked within those messages, and so on.

The data you provide to us when subscribing to the newsletter is used to send you the newsletter, and the legal basis for processing this data is your consent (Article 6(1)(a) of the GDPR) given when you subscribed to the newsletter. As regards the processing of information that does not originate from you but has been collected automatically by our mailing system, we rely in this respect on our legitimate interest (Article 6(1)(f) of the GDPR), which consists of analysing the behaviour of newsletter subscribers in order to optimise our mailing activities.

You may unsubscribe from the newsletter at any time by clicking on the dedicated link included in every newsletter message or simply by contacting us. Even if you unsubscribe from the newsletter, your data will continue to be stored in our database in order to identify returning subscribers and to defend against any claims relating to the sending of the newsletter to you, in particular to demonstrate that you gave your consent to receive the newsletter and the date on which you withdrew it, which constitutes our legitimate interest as referred to in Article 6(1)(f) of the GDPR.

You may amend the details you provided for the purpose of receiving the newsletter at any time by clicking on the relevant link visible in every message sent as part of the newsletter, or simply by contacting us.

Comments and product reviews – details

When adding a comment or review about a product, you must provide at least a username, which will be associated with the comment or review (the username may contain personal data, such as your first name or surname), and an email address. Providing this information is voluntary but necessary to post a comment or review. You may also add your avatar (which may contain your image, e.g. a photograph) and provide your website address, although this is not mandatory.

The data provided in connection with adding a comment or review will be processed for the purpose of publishing the comment or review on the website. The legal basis for processing is your consent (Article 6(1)(a)), which is given by submitting the form used to publish the comment or review. You may withdraw your consent at any time by requesting the removal of your comment or review.

Your comment or review will be publicly available on the website for as long as it remains online, unless you request that it be removed beforehand. You may also edit the content of your comment at any time, as well as amend the details associated with it, such as the information about the person who posted the comment or review.

Correspondence – details

When you contact us, you naturally provide us with your personal data contained in the correspondence, in particular your email address and your first name and surname. Providing this data is voluntary, but necessary to establish contact.

In this case, your data is processed for the purpose of contacting you, and the legal basis for processing is Article 6(1)(f) of the GDPR, i.e. our legitimate interest. The legal basis for processing after the contact has ended is also our legitimate interest in archiving correspondence in order to ensure that we are able to demonstrate certain facts in the future (Article 6(1)(f) of the GDPR).

The content of the correspondence may be archived, and we are unable to specify exactly when it will be deleted. You have the right to request a copy of the correspondence you have exchanged with us (if it has been archived), as well as to request its deletion, unless its archiving is justified on the grounds of our legitimate interests, e.g. defence against potential claims on your part.

Tax and accounting obligations – details

If we issue an invoice to you, it forms part of our accounting records, which will be retained for the period required by law. In such circumstances, your personal data is processed for the purpose of fulfilling our tax and accounting obligations (Article 6(1)(c) of the GDPR in conjunction with the provisions governing tax and accounting obligations).

Archive – details

As part of the description of the specific purposes of personal data processing set out above, we have indicated the retention periods for personal data. These periods are often linked to our archiving of specific data in order to ensure that we are able to demonstrate certain facts in the future, reconstruct the course of our cooperation with the customer, recall correspondence, defend ourselves, or establish or pursue claims. In this regard, we rely on our legitimate interest as referred to in Article 6(1)(f) of the GDPR.

Own-brand marketing – details

As part of our website, we use a mechanism to recover abandoned shopping baskets. If you start the ordering process but do not complete it, our system will record this fact in order to take steps to encourage you to finalise your order. These steps may include, in particular, sending you an email encouraging you to finalise your order or displaying a targeted advert whilst you are browsing the internet.

Our website may also collect information about your activity and, on this basis, display targeted adverts to you whilst you are browsing the internet. However, if you are not a registered user, the information used for this purpose does not constitute personal data. It only becomes personal data once it is combined with your personal data stored in your user account.

We carry out the activities described above on the basis of our legitimate interest, as referred to in Article 6(1)(f) of the GDPR, which consists of marketing our own products.

Analysis, statistics, optimisation – details

We collect statistical information on user behaviour whilst browsing our websites, such as clicks on links, navigation between subpages, time spent on individual pages, etc. We analyse this information to optimise our websites in terms of user experience, effectiveness and conversion rates. In most cases, the information processed in this way does not constitute personal data. The exception is where you are a registered user. In that case, we may combine this information with other data about you stored in your user account.

We carry out the activities described above on the basis of our legitimate interest, as referred to in Article 6(1)(f) of the GDPR, which consists of optimising our websites.

# 7: How long will we retain your personal data?

The data retention periods have been specified separately for each processing purpose. You will find this information in the details relating to each individual processing purpose.

# 8: Who are the recipients of your personal data?

We would go so far as to say that modern business cannot function without the services provided by third parties. We, too, make use of such services. Some of these services involve the processing of your personal data. The external service providers involved in the processing of your personal data are:

  • a hosting provider that stores data on a server,
  • a cloud computing service provider where backups that may contain your personal data are stored,
  • the email system provider where your data is stored if you are a newsletter subscriber,
  • the CRM system provider where we store your data to improve customer service and for archiving purposes,
  • the invoicing system provider, where your data is stored for the purpose of issuing invoices,
  • the accountancy firm that processes your data as shown on invoices,
  • courier companies that process your data to the extent necessary to deliver your order,
  • a law firm, which accesses the data where necessary to provide legal assistance on our behalf,
  • a technical support service provider, which accesses the data where the technical work carried out relates to areas in which personal data is held,
  • other subcontractors who access the data where the scope of their activities requires such access.

Your personal data may also be transferred to tax authorities to the extent necessary to fulfil tax, accounting and reporting obligations. This relates in particular to any declarations, reports, statements and other accounting documents containing your personal data.

Furthermore, where necessary, your personal data may be disclosed to entities, authorities or institutions authorised to access such data under the law, such as the police, security services, courts and public prosecutors’ offices.

Furthermore, we use tools that collect a range of information about you relating to your use of our website. This includes, in particular, the following information:

  • time spent on the website,
  • navigation between individual subpages,
  • clicks on individual links,
  • the source from which you access our website,
  • your age group,

In our view, this information does not, in itself, constitute personal data. As this information is collected by third-party tools that we use, it is also processed by the providers of those tools in accordance with their terms and conditions and privacy policies. Essentially, this information is used to provide and improve services, manage them, develop new services, measure the effectiveness of adverts, protect against fraud and abuse, and personalise the content and adverts displayed on individual services, websites and applications. We have endeavoured to provide details on this matter later in this policy, within the explanations relating to individual tools.

# 9: Do we transfer your data to third countries or international organisations?

No, I do not transfer your personal data to third countries.

I would like to remind you, however, that I use third-party tools which may collect Anonymous Information. I have already mentioned this several times in this policy, including in my answer to the previous question. The providers of these tools often use servers located around the world, particularly in the United States of America (USA), to store the information they collect.

# 10: Do we use profiling? Do we make automated decisions based on your personal data?

We do not make decisions regarding you based solely on automated processing, including profiling, which would produce legal effects concerning you or similarly significantly affect you.

It is true that we use tools which enable us to take specific actions based on information collected through tracking mechanisms, but we believe that these actions do not have a significant impact on you, as they do not differentiate your situation as a customer, do not affect the terms of any contract you may enter into with us, etc.

By using certain tools, we can, for example, show you personalised adverts based on your previous activity on our website, or suggest products that may interest you. This is known as ‘behavioural advertising’. We encourage you to find out more about behavioural advertising, particularly with regard to privacy issues. We would like to emphasise that, within the tools we use, we do not have access to information that would allow us to identify you. The information we are referring to here includes, in particular:

  • information about the operating system and web browser you are using,
  • pages viewed,
  • time spent on the website,
  • navigation between individual subpages,
  • the source from which you accessed our website,
  • your age group,
  • your gender,
  • your approximate location, limited to the town or city,
  • your interests, determined on the basis of your online activity.

We do not link the information listed above to your personal data held in our databases. This information is anonymous and does not allow us to identify you. This information is stored on the servers of the providers of the respective tools, and these servers are usually located around the world.

# 11: What rights do you have in relation to the processing of your personal data?

The GDPR grants you the following potential rights in relation to the processing of your personal data:

  • the right to access your data and receive a copy of it,
  • the right to rectify (correct) your data,
  • the right to erasure (if, in your opinion, there are no grounds for us to process your data, you may request that we erase it),
  • the right to restrict data processing (you may request that we restrict data processing solely to storage or to carrying out actions agreed with you, if, in your opinion, we hold incorrect data or are processing it without justification),
  • the right to object to data processing (you have the right to object to data processing on the basis of a legitimate interest; you should specify the particular circumstances which, in your view, justify our ceasing the processing to which you object; we will cease processing your data for these purposes, unless we demonstrate that the grounds for our processing override your rights or that your data is necessary for us to establish, exercise or defend legal claims),
  • the right to data portability (you have the right to receive from us, in a structured, commonly used and machine-readable format, the personal data you have provided to us on the basis of a contract or your consent; you may instruct us to send this data directly to another organisation),
  • the right to withdraw your consent to the processing of personal data, if you have previously given such consent,
  • the right to lodge a complaint with a supervisory authority (if you believe that we are processing your data unlawfully, you may lodge a complaint in this regard with the President of the Personal Data Protection Office or another competent supervisory authority).

The rules governing the exercise of the rights set out above are described in detail in Articles 16–21 of the GDPR. We encourage you to familiarise yourself with these provisions. For our part, we consider it necessary to explain to you that the rights set out above are not absolute and will not apply to all processing activities involving your personal data.

 

We would like to emphasise that you always have one of the rights listed above: if you consider that we have breached data protection regulations whilst processing your personal data, you have the right to lodge a complaint with the supervisory authority (the President of the Personal Data Protection Office).

Our website, like almost all other websites, uses cookies.

We use cookies on the basis of your consent, except where cookies are necessary for the proper provision of an electronic service to you.

We assume that you consent to all cookies we use that are not blocked by your browser or any additional software you use.

Please note that disabling or restricting the use of cookies may prevent you from using some of the features available on our website and may cause difficulties in using our website, as well as many other websites that use cookies. For example, if you block cookies from social media plugins, the buttons, widgets and social features implemented on our website may not be available to you.

Cookies created in incognito mode are deleted when you close all windows in that mode.

Google Analytics – details

We use the Google Analytics tool provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. We carry out these activities on the basis of our legitimate interest, which consists of compiling and analysing statistics in order to optimise our websites.

In order to use Google Analytics, we have implemented a special Google Analytics tracking code in our website’s source code. The tracking code uses cookies provided by Google LLC for the Google Analytics service. You can block the Google Analytics tracking code at any time by installing the browser add-on provided by Google: https://tools.google.com/dlpage/gaoptout.

Google Analytics automatically collects information about your use of our website. The information collected in this way is usually transmitted to Google’s servers, which may be located anywhere in the world, and stored there.

As we have enabled IP address anonymisation, your IP address is truncated before being transmitted. Only in exceptional cases is the full IP address transmitted to Google’s servers and truncated there. The anonymised IP address transmitted by your browser as part of Google Analytics is, as a rule, not combined with other Google data.

We would like to emphasise that we do not collect any data via Google Analytics that would allow you to be identified. Consequently, the data collected via Google Analytics does not constitute personal data for us. The information to which we have access via Google Analytics includes, in particular:

  • information about the operating system and web browser you are using,
  • the subpages you view on our website,
  • the time spent on our website and its subpages,
  • navigation between individual subpages,
  • the source from which you access our website.

Furthermore, we use the following Advertising Features within Google Analytics:

  • demographic and interest reports,
  • remarketing,
  • ad reporting features, user ID.

We do not collect personal data within the scope of Advertising Features either. The information to which we have access includes, in particular:

  • your age group,
  • your gender,
  • your approximate location, limited to a town or city,
  • your interests, determined on the basis of your online activity.

Google Analytics and Google Analytics 360 have been certified to the independent ISO 27001 security standard. ISO 27001 is one of the most widely recognised standards in the world and certifies that the systems supporting Google Analytics and Google Analytics 360 meet the relevant requirements.

Google Tag Manager – details

We use Google Tag Manager, a tool provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, which enables us to manage tags – small pieces of code that allow us to

monitor user traffic and behaviour, collect information on the effectiveness of adverts, and

take steps to improve our website. Google Tag Manager

does not collect any information that could identify you; however, this tool triggers other tags which, in turn, may collect data.

Google AdWords – details

We use the remarketing features available within the Google AdWords system operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. We carry out these activities on the basis of our legitimate interest in marketing our own products or services.

When you visit our website, a Google remarketing cookie is automatically stored on your device, which collects information about your activity on our site. Thanks to the information collected in this way, we are able to show you adverts within the Google network based on your behaviour on our site. For example, if you view a particular product, this will be recorded by the remarketing cookie, enabling us to show you an advert for that product or any other product we deem appropriate. This advert will be displayed to you within the Google network whilst you are using the internet, browsing other websites, etc.

We would like to emphasise that, when using Google Ads, we do not collect any data that would allow you to be identified. Any combination of data in such a way that it takes on the character of personal data may be carried out by Google, but we are no longer responsible for this, as Google carries out these activities on the basis of a contract concluded with you as a user of Google’s services.

When using Google AdWords, we are only able to define the target audiences to whom we would like our adverts to be shown. On this basis, Google decides when and how to display our advert to you.

Further processing of information takes place only if you have given Google your consent to link your browsing history to your account and to use information from your Google account to personalise the adverts displayed on websites. In such cases, Google will use your data to create and define target audience lists for cross-device remarketing purposes. To this end, Google temporarily combines the information collected with other data it holds to create target groups.
